Terms of Service
These Terms of Service (“Terms”) govern your use of the Pumpy application and related services (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Pumpy is a fitness application that generates algorithmic workout suggestions, tracks training, and provides related statistics and social features. All content - including generated workouts, weights, and recommendations - is provided for general fitness and informational purposes only and is not medical, health, or professional advice.
2. Eligibility & accounts
You must be at least 16 years old (or the minimum age of digital consent in your country) to use the Service. You are responsible for your account credentials, for the accuracy of the information you provide, and for all activity under your account. Access may be invite-based; invite codes are for personal use and may not be sold.
3. Health & safety
Exercise involves inherent risk. You must read and accept the Medical Disclaimer & Assumption of Risk, which is part of these Terms. Consult a physician before starting any exercise program. You train entirely at your own risk.
4. Your content & social features
Your training data remains yours. You grant us the limited license needed to store and process it in order to operate the Service (generating workouts, statistics, backups). Some features share data with other users at your direction: joining a group makes your completed workouts, records, and stats visible to that group’s members; sharing a workout gives recipients a copy they keep. Do not join or share with anyone you do not want seeing that data.
5. Acceptable use
Do not misuse the Service: no unauthorized access, scraping, reverse engineering of non-open components, abusive or unlawful content, harassment of other users, or false contributions to shared data (such as public gym equipment). We may suspend or terminate accounts that violate these Terms.
6. Fees
The Service is currently provided free of charge. We may introduce paid plans or features in the future; any fees, billing terms, and changes will be communicated in advance and will require your acceptance before you are charged.
7. Availability & changes
We may modify, suspend, or discontinue any part of the Service at any time. We aim for high availability but do not guarantee uninterrupted or error-free operation. You can export your data at any time from Settings → Data.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Algorithmic suggestions may be inaccurate or unsuitable for you - use your own judgment.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUMPY, ITS OPERATOR, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY PERSONAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions do not allow certain limitations; in those, these limits apply to the fullest extent permitted.
10. Indemnity
You agree to indemnify and hold harmless the operator from claims arising out of your violation of these Terms or misuse of the Service.
11. Termination
You may delete your account at any time from Settings → Data, which permanently removes your data. We may suspend or terminate accounts for breach of these Terms.
12. Changes to these Terms & governing law
We may update these Terms; material changes will be announced in the app, and continued use after the effective date constitutes acceptance. These Terms are governed by the laws of the State of Israel, and disputes are subject to the exclusive jurisdiction of the competent courts in Israel.
